Terms of Service
Treatly is operated by B-ACTIVO PTY LTD (ABN 26 632 006 805), trading as Treatly, a company registered in Queensland, Australia. References to “Treatly,” “we,” “us,” or “our” in these terms refer to B-ACTIVO PTY LTD.
1.What Treatly is
Treatly is a software tool that helps dental practices create simple, patient-friendly explanations of recommended treatment, including approximate indicative costs, shared with patients via a link.
2.What Treatly is not
Treatly is not a fee-quoting or billing system, does not calculate exact health fund rebates, and does not replace the practice's own practice management or billing software.
Patient-facing procedure descriptions generated by Treatly are general educational summaries of the treatment the dentist has quoted. They are not medical advice, financial advice, or a substitute for the dentist's own clinical explanation, informed consent process, or financial counselling obligations.
All costs shown via Treatly are indicative estimates only, set and controlled by the practice. The practice is solely responsible for confirming exact pricing, rebates, and informed financial consent with the patient.
3.AI-generated content and dentist review
Treatly includes an optional feature that uses AI to read uploaded treatment documents and extract procedure codes, fees, and patient details. AI systems can make errors, including misreading item codes, fees, tooth numbers, or patient contact information.
The practice (and the dentist or staff member creating the plan) is responsible for reviewing all extracted information before sending anything to a patient. Clicking “Confirm & Create Plan” constitutes confirmation that the authorised staff member has reviewed the extracted information and accepts responsibility for its accuracy.
By uploading a document, the practice confirms that it has the right to upload and submit that document, and that doing so does not breach the privacy rights of any patient or third party.
Uploaded documents are processed by an AI service (Anthropic's Claude API) on servers located in the United States. The document is not stored by Treatly and is discarded immediately after extraction. See our Privacy Policy for full details on cross-border processing.
4.Who owns the data
The practice owns all data it enters into Treatly, including its settings, pricing, and the treatment plans it creates. Treatly acts only as the technology platform; we do not claim ownership of practice or patient data.
5.The practice's responsibilities
By using Treatly, the practice agrees that it:
- ●Has the right to share the information it enters about its patients
- ●Has the right to upload and submit any documents it uploads to the platform, and that doing so does not breach the privacy rights of patients or any third party
- ●Will use Treatly in compliance with applicable Australian privacy and health information laws, including its own obligations to patients under the Privacy Act 1988 (Cth)
- ●Is responsible for the accuracy of all pricing, treatment descriptions, and practice details entered into or confirmed within the platform
- ●Will keep its login credentials secure and not share them inappropriately
6.Accounts and access
Each practice manages its own account and can only access its own data. The practice is responsible for who at their practice has login access.
7.Availability
We aim to keep Treatly available and reliable but do not guarantee uninterrupted access. We will make reasonable efforts to notify practices of planned maintenance that may cause downtime.
8.Fees
Starter: Monthly
$79 / month
Billed monthly in advance
Starter: Annual
$799 / year
Billed upfront for the full year
If a payment fails, we will attempt to notify the practice and may suspend access to the practice's dashboard after 14 days of non-payment until payment is received. Any patient treatment plan links already shared with patients before suspension will remain accessible to those patients during this period.
Practices may cancel at any time by contacting treatlyau@gmail.com. No partial refunds are provided for the remaining period of a current billing cycle, but no further charges will occur after cancellation.
We may introduce additional plans or adjust pricing in the future, with reasonable notice provided to existing practices before any price change takes effect on their account.
9.Cancellation
A practice may cancel its account at any time by contacting treatlyau@gmail.com. Upon cancellation, data will be retained per our Privacy Policy's retention period and then deleted.
10.Limitation of liability
Treatly is provided “as is.” To the maximum extent permitted by law, B-ACTIVO PTY LTD (trading as Treatly) is not liable for any clinical decisions, treatment outcomes, or financial discrepancies arising from information entered, uploaded, extracted, or displayed via the platform. This includes errors in information extracted by the AI import feature. The mandatory dentist review step exists so the practice can identify and correct any such errors before a patient sees them. The practice remains solely responsible for the clinical and financial accuracy of information shared with its patients.
This clause is flagged for solicitor review before being relied on with real patient data at scale. We recommend engaging an Australian solicitor to review this section. Many offer a flat fee for small-business document review.
11.Changes to these terms
We may update these terms from time to time, with reasonable notice to practices for material changes.
12.Governing law
These terms are governed by the laws of Queensland, Australia.
